CONTRACTS (RIGHTS OF THIRD PARTIES) ACT 1999 EXCLUSION CLAUSE (CARGO):
The Provisions of the Contracts (Rights of Third Parties) Act 1999 do not apply to this insurance or to any certificate(s) of insurance issued hereunder. Neither this insurance nor any certificates issued hereunder confer any benefits on any third parties. No third party may enforce any term of this insurance of any certificate issued hereunder. This clause shall not affect the rights of the Assured (as assignee or otherwise) or the rights of any loss payee.
1. PERIOD OF COVER
Cover is in force during the normal course of transit from the time the Assured or their representatives take control of the Insured Interest until delivered to final destination, including risks of loss or damage during packing provided goods are professionally packed.
2. AVERAGE CLAUSE
This policy is subject to the condition of average, that is to say, if the property covered by this insurance shall at the time of loss be of greater value than the sum insured hereby the Assured shall only be entitled to recover hereunder such proportion of the said loss as the sum insured by this policy bears to the total value of the said property.
3. PAIRS & SETS CLAUSE
Where any insured item consists of articles in a pair or set this policy is not to pay more than the value of any particular part or parts which may be lost without reference to any special value which such article or articles may have as part of such pair or set, nor more than a proportionate part of such pair or set.
4. DEPRECIATION
Underwriters' liability is restricted to the reasonable cost or repair and no claim is to attach hereto for depreciation consequent thereon.
5. MECHANICAL AND ELECTRICAL DERANGEMENT
Excluding loss of or damage due to mechanical, electrical or electronic derangement unless there is evidence of external damage to the insured item or its packing.
6. CLIMATIC CONDITIONS CLAUSE
Excluding loss or damage by climatic or atmospheric conditions or extremes of temperature.
7. OWNER PACKED EFFECTS
Excluding breakage, scratching, denting, chipping, staining and tearing of owner packed effects, including trunks, suitcases and the like. Also excluding claims for missing items unless a valued list of contents is supplied by owner prior to commencement of transit.
8. EXCLUDED GOODS
Excluding loss of or damage to furs valued over GBP100 or any cash,
notes, stamps, deeds, tickets, travellers cheques, bonds, securities, explosives, livestock, jewellery, watches, precious metals and stones, or similar valuable articles and/or perishable goods including plants.
9. OTHER EXCLUSIONS
Excluding loss or damage due to moth, vermin, wear, tear and gradual deterioration, loss of data records and consequential loss of any kind or description. Also excluded is structural damage to system or kit furniture constructed of veneered chipboard or similar, or any reduction in the quality thereof arising as the result of dismantling or reassembly of any such items of furniture.
10. REPLACEMENT CLAUSE
In the event of loss of or damage to any part of an insured machine caused by a peril covered by the policy the sum recoverable shall not exceed the cost of replacement or repair of such parts or parts plus charges for forwarding and refitting, if incurred, but excluding duty unless the full duty is included in the amount insured, in which case loss, if any, sustained by payment of additional duty shall also be recoverable.
Provided always that in no case shall the liability of underwriters exceed the insured value of the complete machine.
11. ADDITIONAL CLAUSES FOR MOTOR VEHICLES AND/OR MOTOR CYCLES
Subject to pre-shipment condition report.
Quay to Quay but including 5 days prior to shipment and 5 days after discharge but excluding frost damage. Vehicles shipped in crates and/or containerised will be covered from warehouse to warehouse (as applicable) subject to Institute Cargo Clauses (A).
Under deck or held covered at rates and conditions to be agreed.
This insurance does not cover:-
1. Scratching, denting, bruising and claims for repainting and/or the like unless containerised.
2. Loss of accessories and removable items unless lost with the vehicle or shipped separately and the value thereof declared thereon.
3. Vehicles whilst under power except whilst being driven on or off vessels.
4. Rust, oxidisation and discoloration if carried on deck.
At the Removers option, goods may be insured subject to "Restricted Cover", as per Institute Cargo Clauses (C). Such Goods are only insured for physical loss or physical damage, reasonably attributable to: Fire or explosion, vessel or craft being stranded ground sunk or capsized, overturning or derailment of land conveyance, collision or contact of vessel, craft or conveyance with any external object other than water, discharge of cargo at a port of distress or caused by:
General average sacrifice, Jettison
12. REPLACEMENT CLAUSE
1. Note: These instructions form part of the terms and conditions of insurance. Failure to observe them may void the coverage given under the policy.
2. Do not dispose of any damage items until authorised by Underwriters.
3. If there are damages or shortages - endorse the delivery document accordingly.
4. For moves in Europe (including the United Kingdom), all claims must be notified to the Removers or their agents at the time of delivery and confirmed in writing within 7 days. If your removal relates to an International move (outside Europe and the United Kingdom), written notification must be made within 15 days.
5. Notification must include:
(a) Description of each article lost or damaged.
(b) The declared value of each article lost or damaged.
(c) The amount you are claiming for each article
(d) Estimates for repair for claims exceeding GBP100 (or equivalent in other currencies)
(e) Copies of correspondence with carriers and other parties holding them responsible for loss or damage to the goods.
6. The basis of settlement will not be more than the value declared on the proposal form.
7. In some instances claims will be referred to Underwriters' claims agents.
13. EXCESS
The first £ Nil of every claim for loss or damage covered by this insurance shall be borne by the insured customer.
14. CANCELLATION
You have the right to cancel this insurance without penalty at any time prior to when the removal of your property begins. Once the goods are placed into store, your right to cancel ceases and you will be charged the full premium for the insurance up until when you are next due to pay a renewal premium as agreed with us (usually one month). You are then free to cancel this insurance at any time subject to 7 days notice.
Furthermore we will allow you a period of 14 days from the time you receive the Confirmation of Insurance within which, if you decide that you do not want to continue the insurance, you may cancel your cover and get all your money back (as long as you have not made any claims).
15. DISCLOSURE
It is your responsibility, to ensure that all material facts have been disclosed to us i.e. any facts which may affect the Insurer's view of the risk. If you are unsure of whether a fact which has not been detailed in the insurance proposal you have completed needs to be disclosed, it is recommended that details are provided to Insurers for consideration.
Please also ensure that all the information provided by you in your proposal is correct as these details will form the basis of the insurance contract between us. If your circumstances change between the date you purchase the policy and the date when you require the policy to commence, please tell us. Incorrect information or failure to disclose all material facts could invalidate all or part of the cover and result in a claim being declined.
16. COMPLAINTS
If you feel that the service provided to you in respect of the provision of this insurance has not been satisfactory please write and tell us and we will do our best to resolve the problem.
In the event that you remain dissatisfied and wish to make a complaint you can do so at anytime by referring the matter to the Complaints Department at Lloyd's.

17. INSURANCE PREMIUM TAX
Insurance Premium Tax will be charged where applicable, in accordance with current legislation.
18. APPLICABLE LAW
This insurance is subject to English Law and the exclusive jurisdiction of the English Courts.
